ABSTRACT

The American land use common law recognizes three specific kinds of land use decisions–exceptions, variances, and spot zoning–with specific treatment on judicial review. I use Florida cases to present these topics though they are common throughout the United States. This chapter includes the following five cases: City of Naples v. Cent. Plaza of Naples, Inc., Elwyn v. City of Miami, City of Coral Gables v. Geary, Town of Indialantic v. Nance, and Southwest Ranches Homeowners Assoc. v. Broward Cnty.
