ABSTRACT

A person might legally challenge a local government land use decision through one of several avenues under Florida law. This chapter discusses the consistency challenge which is a statutory cause of action providing for a de novo hearing before a circuit court on whether a local government development order is consistent with the applicable comprehensive plan. This chapter includes the following three cases: Pinecrest Lakes, Inc. v. Shidel, Save the Homosassa River Alliance, Inc. v. Citrus Cnty., and Heine v. Lee Cnty.
