ABSTRACT
A person might legally challenge a local government land use decision through one of several avenues under Florida law. This chapter discusses the declaratory judgment which is appropriate for challenging adoption or amendment of a comprehensive plan on some basis other than compliance with state law, for denial of a proposed amendment to a comprehensive plan, or for administrative decisions not eligible for a consistency challenge. This chapter includes the following case: City of St. Pete Beach v. Sowa.
