ABSTRACT

The First Amendment to the U.S. Constitution protects free speech. Local government regulation of signs implicates the First Amendment fundamental right to free speech. In addition, Florida Statutes provide guidance on local government sign regulation. This chapter presents the framework for evaluating when a local government sign regulation violates the substantive due process right to free speech and presents state limitations on local government sign regulation. This chapter includes the following case: Reed v. Town of Gilbert.
