ABSTRACT
This chapter presents Florida state court decisions that describe the distinction between local government legislative and quasi-judicial land use decisions and that apply the strict scrutiny standard to quasi-judicial decisions. The strict scrutiny standard is common to some other states and the text connects Florida case law to significant precedents in other jurisdictions.
This chapter also presents specific procedural due process rights that participants in Florida local government land use hearings possess. This chapter includes the following three cases: Machado v. Musgrove, Brevard Cnty. v. Snyder, and Jennings v. Dade Cnty.
