ABSTRACT

Unfortunately for photographers, the magazine industry is well-organized, and many publishers are modifying contracts under guidelines issued by the Magazine Publishers Association, which unsurprisingly calls for language that benefits publishers at the expense of content creators. The unspoken reality is that the cards are stacked so heavily against young photographers when it comes to contracts as to be justifiably seen as predatory in nature. The age of the photographer is influential because young adults are driven by an insatiable ambition to get their careers off the ground after years in the classroom. The experience a photographer has will also influence whether or not they accept a photo contract provided by a potential client. Most freelancers with several years or more in the business will likely develop a better understanding of how certain contractual terms will impact their lives. Freelancers are going to receive a contract defining rights, payment, indemnification, employment status and more the vast majority of the time.
