ABSTRACT

This chapter examines what a “successful” party in situation or might do to compel the other party to give effect to the award. “Recognition” of an award is a necessary precursor to commencing enforcement proceedings. Different procedures are available for the recognition and/or enforcement of “domestic” and “foreign” awards. A “domestic” award is one which is to be recognised and/or enforced in the state in which it was made whereas a “foreign” award is one in respect of which recognition and/or enforcement is sought in a state other than that in which it was made. The procedure for the recognition and/or enforcement of an award is to be found in the detailed provisions of the law of the state in question. The law of the place where recognition and/or enforcement of an award is sought may contain time limits for the commencement of such proceedings.
