ABSTRACT

Mediators are in a rather curious position with respect to the parties in mediation. In addition to any ethical standards put in place by mediator groups those mediators who are lawyers, former judges, psychologists and those engaged in other professions which have their own ethical standards should be mindful of these ethical standards or canons of conduct regulating or guiding their efforts as mediators. One such example is found in the Ethical Requirements promulgated by the Dispute Board Federation whose mediator panel is used in the mediation of complex infrastructure projects throughout Europe, Africa, the Middle East and Asia. Additionally the European Union has promulgated its own Code of Conduct for Mediators, it states: All Mediators should commit themselves to some form of ethical requirements either in the Mediation agreement, by inclusion of a specific set of ethical rules or by reference to an outside source.
