ABSTRACT

Mediation is a structured problem-solving process in which a neutral, impartial third person or persons assists the parties to the dispute to reach a voluntary agreement to resolve the dispute. The mediator may obtain assistance and independent expert advice with the agreement of and at the expense of the parties. Experts shall be bound and protected by the same rules of confidentiality as those which apply to the mediator and the parties. The mediator may communicate by any means with the parties and may meet with the parties together or with any disputant alone. The parties agree to co-operate with the mediator and each in the conduct of the mediation and to use the best endeavours to comply with reasonable requests made by the mediator to promote the efficient resolution of the dispute. The Parties agree and consent that the disputes arising out of or in connection with this claim, related matters shall be submitted to the Centre for mediation.
