ABSTRACT

Khula is divorce by redemption. When a Singapore Muslim couple have reached agreement to register a divorce by Khula there is a formal exchange, verbally, of the conditions of the divorce. In some Khula divorces the wife redeems herself by making an actual payment in cash to her husband, as well as by surrendering her iddah maintenance and any claims she may have in respect of the mas kahwin. A Khula divorce is a divorce bain sughra, i.e. irrevocable (bain) but allowing of remarriage by the same couple without the prior intervention of the wife's marriage to, and divorce from, another man (after due consummation of the marriage to this intervening husband). The appropriate Khula formulae are exchanged by husband and wife, and the latter immediately pays $22 and secures the registration of the divorce and a copy of the divorce certificate.
