ABSTRACT

In the last chapter, we examined the monetary compensation that is available in the event of a breach of contract. This has the very specific aim of providing monetary relief for the breach of contract, mainly a calculation of damages that would cover the breach that has occurred, usually because of non-performance or other such breach. However, these are not the only remedies available to the non-breaching party. There are also remedies that can be just as valuable in resolving the breach as damages but by providing some form of specific relief. They are often awarded in cases as a form of equitable relief, attempting to achieve what cannot be achieved through a bare calculation of compensation alone. In this chapter, we will discuss these specific remedies and their effectiveness as a compliment or alternative to damages as a remedy for breach.
