ABSTRACT
This section of the book deals with what are referred to as ‘vitiating factors’, which affect the validity of a contract. Vitiating factors arise as a result of actions in the contractual relationship that may affect the subsequent validity of the contract. Where vitiating factors are found to exist in a contractual situation, the result may be that the contract is voidable at the discretion of the innocent party.
