ABSTRACT

Chapter 4 provides an in-depth discussion of ethical and legal factors broadly described, but not often detailed, in available guidebooks and recommendation documentation from guiding organizations. Specific discussed topics include licensing and jurisdiction, cross-state practice and interjurisdictional compacts, evaluating patient appropriateness, informed consent processes with breakdowns of essential components, safety planning, data security related to HIPAA, and methods of ensuring ongoing ethical and legal practice once services begin. Each discussion includes specific details as they apply to clinical practices, with examples. Discussions also outline recommendations for implementation in order to foster ethical, legal, and safe videoconferencing practice.
