ABSTRACT

Chapter 4 examines constitutionally legitimate protest as a First Amendment right and a form of petition of the government for redress versus the intimidation of elected officials as part of a widespread and systematic disinformation campaign. This issue is examined in the context of lawsuits brought by two members of the U.S. Congress against former President Trump et al. in connection with the January 6, 2021, attack on the U.S. Capitol directed towards stopping the certification of the Electoral College results for the 2020 U.S. Presidential election.
