ABSTRACT

The scriptures and gospel provided the basis for Christian natural law thought which developed in the Middle Ages. With the settlement of 1688 and the Bill of Rights 1689, the doctrine of parliamentary supremacy over the King, the prerogative and common law was established. Originally a common law power, the right to a writ was placed on a statutory basis under the Habeas Corpus Act 1679. It is a fundamental principle of international law that states comply with the obligations undertaken through a treaty. Under most constitutions in the world, international law takes precedence over domestic law, entering automatically into a country's legal system once a treaty has been formally approved according to the country's constitutional requirements. However, problems arising over future arrangements for Northern Ireland during the transition/implementation period led the government contrary to basic principle of international law that Treaties must be respected to introduce the Internal Market Bill, a Bill which violated part of the Withdrawal Agreement.
