ABSTRACT

Soldiers who had worked with Darweesh were appalled at how the United States government was treating their former comrade. The order was politically explosive because it was widely interpreted as a “Muslim ban” and was quickly and successfully chal lenged in federal court. Darweesh was, eventually, allowed entry into the country. Few people believe that banning people from the United States based on nothing more than their religious beliefs serves the broader interests of society. The problem of bal ancing the freedom of the individual with the need for social order is a dilemma that raises big questions about the core democratic principle of political freedom. Striking the right balance between individual liberty and the government authority necessary to maintain social order is not an easy task. The United States was founded on the concept of natural or inalienable rights, or the idea that rights cannot be taken away from the individuals who possess them.
