ABSTRACT
This chapter encapsulates the core element of the mutual consent of the contracting parties along with the intention to create a legal relationship between the parties which has been discussed in detail. The Qur’ānic and Sunnah basis of mutual consent, modes of expression and factors which vitiate the mutual consent have also been discussed.
