ABSTRACT

The chapter discusses civil liability issues that affect criminal justice. It examines the statutory basis of civil liability, the concept of immunity and the types of immunity, the concept of “under color of law,” and federal civil rights issues. It also examines the application of the provisions of 42 US Code § 1983 and the use of excessive force by the police. The chapter discusses when the police may use deadly force as well as the liability and immunity of private correctional officers. It looks into what constitutes abusive interrogations along with the statute of limitations for false arrests. The chapter also discusses the issues involved in civil rights in other countries and the duties of an officer to arrest.
