ABSTRACT

The chapter discusses issues on the concept of due process. First, the concept is explained and then the various issues are discussed. There are two due process clauses in the US Constitution. The first clause is in the Fifth Amendment and is used in actions involving the federal government. The second clause is in the Fourteenth Amendment and applies to state and local governments. The chapter discusses how the due process concepts are applied to state and federal prosecutions, the present approach used by the US Supreme Court in determining whether a right should be imposed on state courts, the issues regarding statutes that are considered vague, and the concept of equal protection of the law.
