ABSTRACT

The first normative question to be asked with regard to participation is to which decisions must it apply. Chapter 8 examines these, drawing from the treaties and their interpretation to give an indication of the relevant decisions. The State is obliged to establish a policy with regard to each human right and this should be established, reviewed, and implemented through participation. Other decisions may also affect human rights, and participation should be required in these, particularly where human rights are put at risk. The most intensive form of participation is where communities organise themselves to deliver services related to their rights and the State must respect these under a number of treaties. Finally, the right to participate in public affairs and to self-determination may require participation in further prominent decisions in public affairs.
