ABSTRACT

Chapter 5 analyzes more closely the pushback behavior of the Kenyan government. It shows that despite non-compliance with many court requests, the Kenyan government tried to keep up the appearance of cooperation with the ICC by partially complying with some low-cost court requests. However, the government of President Uhuru Kenyatta also delegitimized the Court, called for exit, and tried to bypass it through domestic and regional legal action because ICC action was targeted at senior political officials, including Kenyatta himself, thus threatening their hold on power. When the ICC ultimately dropped charges against them, the government muted their demands for exit.
