ABSTRACT

The chapter explores the relationship between governmental administrators/regulators of forests and their political overlords. When public citizens object to the decisions and practices of these governmental foresters the issues sometimes end up in court. This type of litigation is especially challenging to forensic foresters since it requires, in addition to the usual technical voir dire, a broad vision and careful separation of personal/political positions from professional expertise. Limited guidelines and examples are offered but the author displays reluctance about entering those debates. The chapter concludes with a description of forest policy cases currently being litigated in Oregon.
