ABSTRACT

This chapter centres its approach on the possibility of overcoming the challenges faced by transnational private regulations (TPRs) in the context of business and human rights. It suggests that to fully achieve TPRs’ potential from an effective compliance point of view, processes of legal empowerment of vulnerable groups are of major importance. Thus, it starts by examining the concept of legal empowerment with a focus on dynamics related to TPRs in business and human rights. Afterwards, this chapter addresses key points to evaluate the extent to which a legal empowerment perspective can contribute to overcoming the main challenges faced by TPRs, in particular whether the participation of vulnerable stakeholders in processes related to TPRs contributes to perceiving such normative frameworks as legitimate regulatory means is addressed.
