ABSTRACT

This chapter discusses the difficult position of this right in relation to other rights. The idea that someone should have the right to live in privacy is widely accepted. In the private sphere, other issues play a role. In labour law relations for instance, the question arises to what extent the private activities and beliefs of an employee may play a role in the labour relation with the employer. In 2013, the Financial Times published a report in which industry pricing data was analysed. The situation is more delicate when the police decide to publish an video of suspected criminals, and social media users are able to track and trace those suspects, publicly naming and shaming them. Social media users responded furiously to this video. The Child Pornography Prevention Act (CPPA) of 1996 broadened the scope regarding the kind of child porn that was banned on the United States (US) markets.
