ABSTRACT
Effective legal representation goes beyond presence at the hearing or even the granting of parole. Attorneys protect the rights of their juvenile lifer clients in a highly discretionary setting through zealous advocacy and stepping in when there is any perceived unfairness. A meaningful opportunity is further facilitated when attorneys can prepare a client to present credible explanations for their mitigated culpability and highlight their rehabilitative efforts. However, the defense of youth is balanced by ensuring that a juvenile lifer does not use their mitigated culpability as a reason to excuse their responsibility for the offense. Attorneys are also cognizant of painting a full picture of their client’s maturity and rehabilitation. Ultimately, a meaningful opportunity is not only qualified in terms of a positive parole vote but through shorter interval terms that offer hope for release. Therefore, the type of client, amount of preparation, and the style of relationship contextualizes how legal representation enables a meaningful opportunity for release.
