ABSTRACT

This chapter sets out briefly the theoretical bases of deterrence, acknowledging that they are fundamentally intertwined with our notions of punishment. Authors have given particularly careful consideration to the impact on his children, parents and staff. Specific deterrence that aimed at the individual who has committed this crime to dissuade them from committing further crimes, has a much narrower focus than general deterrence. As noted by Blakely, this is an important distinction: in specific deterrence, a crime has already been committed by the person it is hoped will be deterred in the future. When sentencing II, who had a previous conviction for carrying a knife, the Judge was clear that the mandatory minimum was for both general and specific deterrence and was thus justified for II. Another, slightly different, way in which the 'Sword of Damocles' can be hung over a defendant is by the use of an SSO.
