ABSTRACT

In this chapter, we discuss the laws relating to the registration of title. The legal framework has evolved by fundamental changes made by the Land Registration Act 2002 (LRA 2002). LRA 2002 came into force on 13 October 2003. This legislation repealed its predecessor Land Registration Act 1925. It is very important for you to remember that the law of registered title land is very different from that of unregistered land. Whereas in the unregistered system a purchaser would require a vendor (seller) to show a good root of title (15 years) and hence a fresh investigation of title would be necessary on each sale, in the registered system the legal title would be investigated just once (by the Land Registrar) and then registered. At the end of this chapter, you shall be able to see how the system of registration of title has been designed to simplify conveyancing.
