ABSTRACT

This chapter addresses this difference in respect to licences and proprietary estoppel. Licences are personal rights to enjoy some rights or privileges over someone else’s land. On the contrary, a proprietary estoppel (PE) is proprietary in nature so it can bind a third party. A licence is a permission given by the owner of a piece of land to another person, who may or may not own the land themselves, to use the owner’s land for some specific purposes. This chapter looks at types of licenses as well as what the conditions of a proprietary estoppel (PE) are.
