ABSTRACT

Construction projects were significantly delayed, postponed or terminated as a result of COVID-19; those that continued were subject to increased costs as a result of the health measures required to keep workers safe. Chapter 12 discusses the measures that governments took to ameliorate the impacts of COVID-19 on the execution of construction projects and the operation of construction contracts. The rights arising under common law and civil law for the time and cost impacts are discussed. Examples of general legislation providing relief for hardship or force majeure are discussed, as well as specific legislation providing contractual relief. The types of claims arising under FIDIC contracts from COVID-19 are reviewed. Examples are provided of measures passed by governments to provide economic relief to assist Contractors. Changes to dispute resolution as a result of the impact of COVID-19 are briefly discussed.
