ABSTRACT
Chapter 29 discusses the challenges of using different methods of dispute resolution for international construction disputes in the post COVID-19 environment. Protagonists have the choice of “jaw-jaw” methods involving discussion, negotiation and compromise (such as mediation) or “war-war” adversarial methods in which an independent Neutral will determine legal rights in a winner takes all process, typically arbitration.
