ABSTRACT

Mutual vindication of rights may be possible in adjudication and may be further facilitated if all involved focus on respecting the human dignity of everyone. Conflicts between competing human rights claims provide an opportunity to seek solutions that will mutually vindicate the rights and freedoms of everyone involved. In the last 70 years, human dignity has emerged as an important principle in adjudicating rights claims. Very specific rights may not follow of necessity from a general recognition of human dignity. Focusing on human dignity for everyone involved may open our horizons to strategies to seek mutual vindication of rights rather than a straightforward victory of one right over another. Human dignity for everyone everywhere could focus on the broader dignitary interests at stake, especially those of the children who are awaiting placement. Human dignity for everyone everywhere reminds the reader that compromise is essential in pluralistic societies.
