ABSTRACT

This chapter starts by categorising different nudge interventions, using a classification based on who is designing and who is implementing them. Private, public and regulatory nudges emerge as fundamentally distinct categories that should inform normative discussions around nudging. Regulatory nudges – the main focus of this book – are those designed by the state and implemented at business level. The understanding of regulatory nudges is also further clarified in this chapter, matching the widespread academic understanding of nudges as a minimalist regulatory instrument. This conceptual chapter also identifies operational challenges that each of the nudge categories identified faces, with a focus on regulatory nudges. With its three categories of nudges, this chapter delineates the different spaces that nudging has occupied, setting the regulatory domain apart from the others.
