ABSTRACT

This chapter analyses the public policy issue before the enforcement of non-ICSID awards under the New York Convention. Legal analyses of public policy are divided into national public policy and international public policy. While examining these two perspectives, related cases are exampled and two conventions (the ICSID Convention and New York Convention) are compared regarding their enforceability in practice by indicating already concluded empirical works for non-compliance investment arbitral awards. The chapter not only discusses the enforcement issue from the foreign investor perspective, but it also considers it from host states.
