ABSTRACT

Chapter 1 sets out the initial effects which losses suffered on international consignments of Fresh Produce have on exporters and importers and other stakeholders.

It reviews the potential damage to relationships between exporters and importers on the one hand, and importers and their customers on the other, which is often caused by failure to deal promptly and thoroughly with these losses.

It emphasises that work on claims must be ‘front-loaded’; the relevant vital actions must never be delayed. ‘Front-loading’ the necessary work must be the order of the day.

In the vast majority of cases, ‘front-loading’ the work routinely leads quickly to establishing the cause of the loss.

The Introduction leads on to:

A broad understanding of the legal framework underpinning claims for damages without straying into academic territory;

Detailed procedures to be adopted in controlling losses by proper investigation and reporting of the causes;

Claim evaluation and the preparation of evidence and documents for claim submission to carriers;
