ABSTRACT

When claimants fail to obtain settlements, their options are considered in this chapter.

Dispute Resolution, P&I clubs, and Jurisdiction are considered.

Clearly, the prospect of enormous and uncontrollable legal costs is a real fear for claimants, and for the majority of claimants litigation is an ‘undiscovered country’, and many have elected to abandon their claims rather than explore that option.

This chapter seeks to demystify litigation, the incurring of costs, and the undertaking of litigation risk as far as is possible.
