ABSTRACT

This chapter examines Donald Trump’s unorthodox use of the pardoning power as the Outlaw-in-Chief. It provides a review of the ongoing civil and criminal lawsuits against the former president, as well as the pending lawsuits vs. Trump family members and the Trump Organization, Inc. As 2022 began, Trump was still very busy dodging prosecution for allegedly a myriad of criminal offenses. These have involved most if not all categories of organizational crime, as well as sex offenses, violations of national security, and most likely some violations that fall under miscellaneous. White-collar crimes annually make up just over three percent of federal prosecutions. Like most white-collar and corporate crimes in the United States, business violations of immigration laws such as knowingly hiring people without the proper paperwork are rarely enforced. Trump has been under criminal investigation in several jurisdictions, and should he be indicted and prosecuted, he would be the first former president in American history to face criminal adjudication.
