ABSTRACT

This chapter introduces readers to the International Criminal Court (ICC), including crimes under its jurisdiction and preconditions to its exercise of jurisdiction. Of particular interest are the crimes against humanity of deportation, persecution and other inhumane acts against the Rohingya in which at least one element or part of such a crime is committed in Bangladesh, a State Party to the Rome Statute of the ICC. Direct responsibility and commander/superior responsibility will be explained. The chapter will indicate necessary steps to be taken by the ICC vis-à-vis Myanmar accused and explore how high-ranking civilians have been brought to face justice in international criminal tribunals.
