ABSTRACT

Once we've scouted and chosen our locations, we need to ensure that we have the legal right to shoot there. If we are shooting on public property, we may need a shooting permit. If we are shooting on private property, we should have a location release. Trespassing also occurs when our rights to be on somebody's property have expired. Chattel is the legal term for physical property, as distinguished from real property, the legal term for land and the houses on it. Trespass to chattels occurs when we interfere with somebody's right of possession to their physical property. Photographing people on private property when they have a reasonable expectation of privacy may violate their rights.
