ABSTRACT

Most filmmakers would like to get their movies on to over-the-top television platforms like Netflix, Hulu, Amazon Prime, and iTunes. However, most OTT platforms won't take our film—that is, not directly. These services have become so popular, and so inundated with independent films, that they require films be submitted via a content aggregator. Aggregators usually have relationships with popular online video portals, such as iTunes and Netflix, and may be the only way to get our film on such sites. As a result, working with an aggregator is like working with a distributor in that the relationship requires the filmmaker to pay careful attention to the exclusive rights. The aggregator should be required to send periodic accounting statements as well as grant access to its books for an audit no less frequently than once per year. Producers uploading their video stand to gain 50% of the net revenues from films that Amazon subscribers buy or rent.
