ABSTRACT

The chapter deals with recent changes and challenges post Brexit under the Freedom of Information Act 2000 (FOIA) and the changing role of the Information Commissioner in terms of new and existing legislation, such as the UKGDPR and data privacy. Legal challenges involving FOIA access requests, such as Andrew Lownie v The Information Commissioner, The Foreign and Commonwealth Office and The National Archives, a biographer who sought access to the ‘Mountbatten diaries’, archived at Southampton University in 2017, where access was denied on the advice from the Cabinet Office. The chapter includes updated data protection legislation post Brexit including the recent CJEU ruling in Max Schrems II.
