ABSTRACT

This chapter analyzes several court cases related to ‘moisture loss’ from the trial court to the supreme court in California. The Washington State supreme court found in favor of the principle of ‘net weight at time of sale’ (1913) but the United States supreme court eventually ruled in favor of allowing a reasonable variation from declared net contents due to ‘moisture loss’ (1977). There is a brief discussion of the transition from ‘wet tare’ to ‘used dry tare.’ The concept of ‘moisture loss’ has had a profound effect on inspections conducted to determine compliance with ‘net contents of packaged goods.’
