ABSTRACT

This chapter focuses on key definitions, in order to understand how the general principles of law are applied to the Master. The statutory provisions explain who the Master is, their responsibilities to Flag and Port States and their relationship with the owner. Perhaps surprisingly, the definition of a ship lacks the same universal clarity, which demands a comparative study of laws in different jurisdictions. This enables a clearer picture to emerge in two key areas, the Master’s responsibility for safe navigation, and the Master’s overriding duty to maintain order and discipline. While the former unquestionably is defined under international law, the latter is more deeply involved with the Master’s risk management under the Flag State’s domestic law, which introduces us to the next section.
