ABSTRACT

This chapter considers the second case study, Denmark, and the use of impeachment in the Danish system. The chapter will begin by comparing the UK and Danish constitutions, before considering how impeachment operates in Denmark. There will then be a review of the impeachment of Erik Ninn-Hansen, the Minister of Justice, who was impeached in 1993 and Ninn-Hansen’s subsequent application to the European Court of Human Rights. Denmark was chosen as a case study for a number of reasons, including its membership of the Council of Europe and its obligations under the European Convention on Human Rights.
