ABSTRACT

This chapter provides the research goals via analysing the research findings on empirical account. It explores the difference between mainstream society which makes available the rights and duties to only those who fit in binary system of sex and gender also single orientation i.e. heterosexual. Sexual minority are often misunderstood by society and rejected by family, friends, communities, employers, social sector and other service providers. Laws also make an environment of abuse which includes; Laws criminalizing homosexuality; Laws criminalizing other forms of consensual sexual activity, including sex work; Laws criminalizing public behaviour in the name of morals, “decency,” or “public scandal”. A detailed survey of existing literature reveals that there is dearth of study with reference to Sexual Minority within the Indian law especially Criminal Justice System and its comparison with treatment with sexual minority in global Criminal Justice Systems.
