ABSTRACT

The purpose of Chapter 7 is to consider the issue of the feasibility of an international obligation. This issue is related, on the one hand, to the subjective and objective possibility and conditions of enforcing an obligation and, on the other hand, to the instruments for inducing parties to properly perform obligations, the management of the enforcement process, and enforcement. In addition, it is a matter of demonstrating the link between the performance of obligations and related concepts such as compliance, management, and enforcement of obligations. The considerations covered in Chapter 7 include the concept of the feasibility of an obligation, including its subjective and objective aspects, the legal and non-legal conditions for the performance of international obligations. It also discusses measures to be taken to induce or encourage parties to fulfil their obligations (compliance), appropriate management of obligations (including suspension of obligations and performance security), or to be compelled to comply with obligations (enforcement, including countermeasures, and sanctions).
