ABSTRACT

This chapter contains concluding remarks on the status of the law and practice relating to language fair trial rights in Africa and beyond. The language fair trial rights code embodies over 30 principles, which have been tried and tested among jurisdictions around the world, to ensure the language fair trial rights of all participants in court proceedings. Among others, an accused person is entitled to understand clearly the language used in the proceedings, and the court is obliged to make a determination that the accused person actually understands the proceedings. This may require effective interpreting of proceedings, translation of process, use of intermediaries, or deployment of special measures.
