ABSTRACT

This chapter is at the heart of this book and discusses different coercive measures that national and international sports federations could possibly using during their internal investigation proceedings, such as house searches, video surveillance and polygraph tests. It will conclude that sports associations enjoy a certain margin of appreciation in the application of coercive investigative measures in sports investigation proceedings. The legitimacy of the use of coercive powers is, however, limited by the substantive and procedural rights of natural and legal sportspersons. The misuse of power and the forced nature of coercive investigative measures are common concerns in relation to the security of the privacy rights of sportspersons.
