ABSTRACT

Chapter 5 legally examines the exchange of information between sports organisations, on the one hand, and law enforcement agencies, betting companies or other third parties, on the other hand. In particular, the parallelism between sports investigation proceedings and criminal procedures has increased the level of cooperation between private sports organisations and law enforcement agencies. The danger, then, is that the incriminating information is disclosed to law enforcement agencies who initiate a criminal investigation into the sportsperson for alleged criminal wrongdoing, which may result in criminal charges and prosecution. This chapter will therefore analysis the interplay between the cooperation between sports organisations and third parties and discusses whether or not the procedural and substantive rights of sportspersons are efficiently protected.
