ABSTRACT

The chapter deals with a coronavirus pandemic that could act as a Derridean spectre—an ideological depersonalized conscience. The Covid-19 pandemic highlights many of the errors and flaws of contemporary (demo)liberalism: its attitude to economics and capitalism, to the ‘cheap’ Earth that should be subjugated, to the ‘social basis’ of legal transplants, to hegemonic processes of colonization, and finally to the metaphysics of Rights, which, despite its universalist claims, has in practice turned out to be a minority religion included in countless legal texts, in many important judgements and decisions, but poorly rooted in realpolitik. The coronavirus pandemic results in the evident domination of biopolitics not only over the content of the law, but also over the liberal legal form, which seemed an unquestionable element of the liberal ‘end of history’.
