ABSTRACT

This chapter continues with the discussion from Chapter 2 on the concept of public health engraved in the WTO system. Compared to WTO's historically expanded authority on product-borne health risks in trade shown in Chapter 2, this chapter points out how stakes are becoming high for global public health promotion with the international system struggling against “human-borne” health risks that have emerged with full force at the turn of the century. Hence, a new definition of public health is put forward that can be conditionally applied in the trade framework under global health emergencies.
